1. Overview

Welcome to PupFest. In these Terms of Service (the “Terms”), the words “we”, “us”, and “our” refer to PupFest, and “you” refers to the customer or visitor using our website. PupFest operates this website and provides related information, content, features, tools, products, and services (together, the “Services”).

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or purchasing from the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility and Accounts

By agreeing to these Terms, you confirm that you are at least the age of majority in your country or region of residence, or that you are using the Services with the consent and supervision of a parent or legal guardian.

To place an order, you may be asked to provide information such as your name, email address, billing details, and shipping address. You represent that all information you provide is accurate, current, and complete, and that you have the right to provide it. If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account.

3. Products and Personalized Goods

PupFest sells custom, made-to-order, and print-on-demand products, including hand-finished and personalized pet portraits. Because each item is produced individually based on the details and content you provide, our products are customized and personalized goods.

We make every effort to display our products accurately. However, colors and appearance may vary depending on your device, screen settings, and the nature of printing and hand-finishing processes. Minor variations are inherent to custom production and are not considered defects. All product descriptions, pricing, and availability may change at any time without notice, and we may limit or discontinue any product at our discretion.

4. Customer-Provided Content

Some products require you to upload photographs, images, text, or other content (“Customer Content”) so that we can create your item. You represent and warrant that:

You own or have all necessary rights, licenses, and permissions to use and submit the Customer Content;
The Customer Content does not infringe the intellectual property, privacy, or other rights of any third party; and
The Customer Content is not unlawful, offensive, or otherwise objectionable.

You grant us a limited, non-exclusive licence to use, reproduce, and adapt the Customer Content solely for the purpose of producing, fulfilling, and supporting your order. We may decline or cancel any order containing content that we reasonably believe to be unlawful or infringing.

5. Orders and Acceptance

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. We reserve the right to accept or decline any order at our discretion, including after confirmation, for reasons such as product availability, errors in pricing or product information, or suspected fraud.

Because our products are made to order, we may be unable to change or cancel an order once production has begun. Returns, refunds, and cancellations are handled solely in accordance with our Refund Policy.

6. Prices, Taxes, and Payment

Prices, discounts, and promotions are subject to change without notice. The price charged is the price displayed at the time your order is placed and confirmed in your order confirmation email. Unless expressly stated, prices do not include taxes, shipping, handling, or any customs or import charges, which may be added at checkout or be payable on delivery.

Payments are processed by third-party payment providers. You represent and warrant that you are authorised to use the payment method you provide and that the payment information is accurate. You agree to pay all charges incurred at the posted prices, including applicable taxes and shipping.

7. Shipping and Delivery

Shipping methods, rates, and estimated delivery times are described in our Shipping Policy, which forms part of these Terms. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or other events beyond our reasonable control. Responsibility for the goods passes to you upon delivery to the address you provide, subject to your mandatory statutory rights.

8. Intellectual Property

The Services, including all text, graphics, logos, images, designs, and their selection and arrangement, are owned by PupFest or its licensors and are protected by applicable intellectual property laws. You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish, or otherwise exploit any part of the Services without our prior written consent.

“PupFest”, our logos, and our product names are trademarks of PupFest. All other trademarks appearing on the Services are the property of their respective owners.

9. Prohibited Uses

You may use the Services only for lawful purposes. You agree not to use the Services:

For any unlawful, fraudulent, or malicious purpose, or in violation of any applicable law or regulation;
To infringe our intellectual property rights or those of any third party;
To harass, abuse, defame, or harm any person;
To transmit false or misleading information, spam, or any malicious code; or
To interfere with, disrupt, or circumvent the security or proper functioning of the Services.

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms.

10. Third-Party Links and Tools

The Services may contain links to, or make available tools from, third parties that we do not control. We provide these “as is” and “as available”, without warranties of any kind, and we are not responsible for the content, products, services, or practices of any third party. Your use of third-party websites and tools is at your own risk and subject to their own terms and policies.

11. Disclaimer of Warranties

Except as expressly stated by us or required by mandatory law, the Services and all products are provided on an “as is” and “as available” basis, without warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer protection law.

12. Limitation of Liability

To the fullest extent permitted by law, PupFest and its owners, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or replacement costs, arising from your use of the Services or any products purchased through them. Nothing in these Terms limits or excludes our liability where such limitation is prohibited by applicable law, including liability under mandatory consumer protection legislation.

13. Indemnification

You agree to indemnify and hold harmless PupFest and its owners, employees, and agents from any claims, damages, liabilities, and reasonable legal costs arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) any Customer Content you submit.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any conduct that we reasonably believe violates these Terms or is harmful to us or others. Provisions that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles and without prejudice to any mandatory consumer protection rights you may have in your country of residence. Where a dispute cannot be resolved amicably, it may be brought before the competent courts of Sweden or of your place of residence, as permitted by applicable law.

If you are a consumer resident in the European Union, you may also submit disputes to the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are always happy to try to resolve any issue directly first — please contact us before initiating a formal dispute.

16. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with an updated “Last updated” date. Changes take effect upon publication and do not apply retroactively. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

17. General

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Services. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or sale of assets.
